By accessing or using the services provided by In Da Wind Logistics & Brokerage Firm LLC ("In Da Wind," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.
In Da Wind provides logistics, carrier, courier, and freight brokerage services, including full truckload (FTL), less-than-truckload (LTL), expedited delivery, and brokerage solutions. We reserve the right to modify, suspend, or discontinue any service at any time without notice.
Drivers and independent contractors who register through our portal represent that all submitted information, credentials, and documentation are accurate and current. You are responsible for maintaining valid commercial licenses, insurance, and any required regulatory compliance (DOT, MC, etc.) while operating on our behalf.
Shippers are responsible for providing accurate shipment details, including origin, destination, cargo description, weight, and any special handling requirements. Misrepresentation of cargo may result in refusal of service and cancellation of shipments.
Payment terms for drivers and carriers are outlined in individual agreements and rate confirmations. In Da Wind reserves the right to withhold payment for incomplete, damaged, or non-compliant deliveries. Invoices are processed according to the method and schedule agreed upon at booking.
In Da Wind acts as a broker and logistics coordinator. While we vet carriers and drivers, we are not liable for acts of God, traffic incidents, delays caused by third parties, or cargo loss beyond the limits of insurance coverage. Claims must be filed within 30 days of the incident.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use or security breach.
We may suspend or terminate access to our services at any time, with or without cause, including for violations of these Terms. Upon termination, all outstanding obligations remain in effect until fulfilled.
We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
